Centre for Comparative and Public Law, Faculty of Law, The
University of Hong Kong
Constitutional Dialogue Between the New Zealand Courts and Parliament
Has our "Rule of Law" story changed forever, or is this just growing
pains?
Malcolm Luey, New Zealand Ministry of Justice
Tuesday, 8 November 2011, 1:00 - 2:00 pm, Room 404, 4/F TT Tsui
Building, The University of Hong Kong
With
the recently announced New Zealand Constitutional Review about to begin,
many are once again pondering the continuing tension between the
traditional concepts of "rule of law" and "parliamentary sovereignty".
At the heart of this debate lies the desired relationship or
interactions between the courts and parliament, often referred to as a
"constitutional dialogue" between these two essential pillars of modern
governance. This tension is often most acute when issues of fundamental
human rights arise and Lord Bingham's notions of "thin" or "broad" rule
of law are put to the test. This seminar will review recent court and
parliamentary events that illustrate how this constitutional dialogue
continues to evolve and examines the impact of the entrenchment debates
during the creation of the New Zealand Bill of Rights and the relatively
recent creation of a New Zealand Supreme Court.
Malcolm Luey was a 2007 Sohmen Visiting Human Rights Scholar and is
currently the manager of criminal law policy in the New Zealand Ministry
of Justice. Malcolm began his career with human rights litigation in
the 1990 and has since worked throughout the New Zealand public service
as an advisor and litigator on domestic and international human rights
issues. Highlights of Malcolm's career include working on the NZ Code
of Health and Disability Consumers' Rights, the creation of the
International Criminal Court, the 2000 review of New Zealand Human
Rights Protections, legislation for NZ courts' to make declarations of
inconsistency regarding unjustifiably discriminatory legislation,
appearing before the NZ Supreme Court in some of their first human
rights cases, the Search and Surveillance Bill and the recent enactment
of the Criminal Procedure (Reform and Modernisation) Bill which
represents the most significant reform of NZ criminal procedure in over
50 years.

Education
Executive Study Group
Initiated by the Chinese University of Hong Kong with the Hong Kong
Science & Technology Parks Corp. in 2009, the Executive Study Group has
become a monthly gathering which facilitates networking and interactions
between academics and senior executives of leading enterprises.
Topic of October:
Right Things to Do Before a Downturn of 2012
§
McKinsey’s September research shows that most executives think a
double-dip recession will hit economies over the next 6 months.
§
Surprisingly, most companies don’t adequately plan ahead, often reacting
to a downturn by embarking on a costly, damaging cycle of doing too
much, too late, and too randomly.
§
Companies that survive and thrive during tough economic times build
advantages in three critical areas: mindset, preparation, and execution.
§
They even look for weaknesses in their competitors and seek
opportunities to make inroads against them.

Six Secret Formulas from Private
Equity to Boost Company Performance
§
When private equity firms like BlackRock can make 500% returns
on their initial investment in just 3 to 5 years, people are
amazed by their huge success.
§
This is because they do not just invest passively, but they also
assist their portfolio companies to boost performance.
§
We can also learn from their secret formula to improve our own
company’s performance and they are to:
1.
Break the existing “satisfactory underperformance”
2.
Develop a blueprint detailing how to turn initiatives into
results
3.
Accelerate performance by implementing a rigorous program
4.
Reward generously for managers to think and act like owners
5.
Manage working capital aggressively and discipline capital
expenditures
6.
Foster a results-oriented mind-set
§
By applying these six secret formulas from private equity, you
can also increase your shareholder values in a foreseeable
future.

Topic for January 2011:
Seven Ways to Grow More with Less
-
When 2011 is approaching, many business leaders start to seek
revenues and profits growth by extending their existing product
lines and brands, as well as by entering new geographic regions.
-
But this strategy diffuses the organization’s efforts to become less
competitive. Instead, companies should follow a seven-step strategy
for achieving more with less:
1.
Discover what is working well and where the company is already winning
2.
Cluster and prioritize growth themes to define the focused bets
3.
Summarize strategies in a compelling yet simple vision
4.
Find the right people and to place disproportionate resources in their
hands
5.
Make decision making needs closer to customers so that managers have the
operating freedom
6.
Create communities and networks across the company, formal as well as
informal
7.
Keep scorecards objective and simple
