Constitutional Dialogue Between the New Zealand Courts and Parliament
Has our "Rule of Law" story changed forever, or is this just growing pains?

With the recently announced New Zealand Constitutional Review about to begin, many are once again pondering the continuing tension between the traditional concepts of "rule of law" and "parliamentary sovereignty". At the heart of this debate lies the desired relationship or interactions between the courts and parliament, often referred to as a "constitutional dialogue" between these two essential pillars of modern governance.  This tension is often most acute when issues of fundamental human rights arise and Lord Bingham's notions of "thin" or "broad" rule of law are put to the test.  This seminar will review recent court and parliamentary events that illustrate how this constitutional dialogue continues to evolve and examines the impact of the entrenchment debates during the creation of the New Zealand Bill of Rights and the relatively recent creation of a New Zealand Supreme Court.

Malcolm Luey was a 2007 Sohmen Visiting Human Rights Scholar and is currently the manager of criminal law policy in the New Zealand Ministry of Justice.  Malcolm began his career with human rights litigation in the 1990 and has since worked throughout the New Zealand public service as an advisor and litigator on domestic and international human rights issues.  Highlights of Malcolm's career include working on the NZ Code of Health and Disability Consumers' Rights, the creation of the International Criminal Court, the 2000 review of New Zealand Human Rights Protections, legislation for NZ courts' to make declarations of inconsistency regarding unjustifiably discriminatory legislation, appearing before the NZ Supreme Court in some of their first human rights cases, the Search and Surveillance Bill and the recent enactment of the Criminal Procedure (Reform and Modernisation) Bill which represents the most significant reform of NZ criminal procedure in over 50 years.

Full-tuition Entrance Scholarships Available for Outstanding Students

The Chinese University of Hong Kong (CUHK) is now inviting undergraduate applications from international students for 2012 entry. A number of full-tuition entrance scholarships are available to outstanding students. Children of foreign nationals holding dependant visas, if admitted, would be considered as local students and entitled to pay local fees.

The Chinese University of Hong Kong has been placed 37th among the world's top universities and 5th among the top Asian Universities in 2011 according to QS World University Rankings. It has a population of over 20,000 students including some 3,800 international students from over 45 countries. The University has forged academic links with institutions of higher learning around the world, and reached student exchange agreements with some 220 universities, including Cornell, Harvard, Peking, Yale, University College London, the Copenhagen Business School and the University of California system.

As CLIHK is expanding its intake of international students, we would welcome applications from students from New Zealand. In addition, to facilitate outstanding candidates in making informed decisions among all early offers they receive from the various universities, candidates who apply to CUHK on or before 15 November 2011 will be considered for advance offers. Joint Business Community Luncheon : Post Policy Address 

The HKSAR Chief Executive the Honourable Donald Tsang will deliver his policy address to the Legislative Council in mid-October 2011. We are pleased that Mr Tsang has accepted our invitation to talk to the Hong Kong business community at a joint luncheon which to be held on Wednesday, 2 November 2011.

This series covers a wider spectrum of topics from tacit knowledge in family investment to NextGen career analysis.  The series is also delivered in more interactive formats from workshops, case studies, to business family roundtable.  As always, the series grounds on professional knowledge and the latest research in the field. Description
Other than doing traditional export business, more family businesses are now looking to make more commitment to secure a competitive position by doing direct investments in the globalized world. This workshop aims to analyze the situation of family multi-national corporations and focus on their cultural risks in creating new companies or making foreign direct investments in other countries. Starting with some theoretical principles and academic analysis, the workshop leaders will lead participants on learning how to prepare effectively in interacting with clients, employees, and external decision makers in the target country of doing business.  They will also discuss the role of tacit managerial knowledge in being successful in a foreign cultural setting, by offering specific examples taken from the nearly 3,000 responses of TKIM assessment survey from various countries.
